I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts you conclude with us as the provider (Julian Helbig) via the website www.magicmic.eu. Unless otherwise agreed, your own terms and conditions are not accepted.
(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that predominantly are neither commercial nor self-employed. An entrepreneur is any natural or legal person or a legally responsible partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.
§ 2 Conclusion of the Contract
(1) The subject of the contract is the sale of goods.
(2) By placing the respective product on our website, we make a binding offer to conclude a contract under the conditions stated in the item description via the online shopping cart system.
(3) The contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the "shopping cart." You can call up the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time. After clicking the "Checkout" or "Proceed to Order" button (or a similar term) and entering your personal data as well as payment and shipping conditions, the order data will be displayed as an order overview.
If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be taken to the order overview page on our online shop or redirected to the website of the instant payment system provider. If redirected, enter the necessary data and confirm the payment instruction. Finally, you will be shown the order data as an order overview either on the provider's website or after being redirected back to our online shop.
Before submitting the order, you can review and amend the details in the order overview or cancel the order using the browser’s "back" function.
By submitting the order via the appropriate button ("order with obligation to pay," "buy" / "buy now," "place binding order," "pay" / "pay now," or similar), you declare legally binding acceptance of the offer, resulting in the conclusion of the contract.
(4) Your inquiries to prepare an offer are non-binding. We will send you a binding offer in text form (e.g., by email), which you can accept within 5 days (unless a different period is stated).
(5) The order processing and transmission of all necessary information in connection with the contract is partly automated via email. You must therefore ensure that the email address provided is correct, and that the receipt of emails is technically ensured and not blocked by spam filters.
§ 3 Special Agreements Regarding Payment Methods
(1) Payment by SOFORT / Sofortüberweisung If you select SOFORT / Sofortüberweisung, payment is processed via Sofort GmbH (Theresienhöhe 12, 80339 Munich, Germany; "SOFORT"), a company of the Klarna Group (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden). You must have an online banking account activated for SOFORT. During the payment process, you authorize the transaction with SOFORT. Your account is debited immediately after submitting the order. (2) Payment via Klarna In cooperation with Klarna Bank AB (publ), we offer the following payment options, processed by Klarna:

- SEPA Direct Debit ("Pay Now")
- Credit Card Use of invoice and/or installment purchase and/or direct debit requires a positive credit check. Your data will be shared with Klarna for address and creditworthiness verification. (3) Payment via PayPal / PayPal Checkout If you choose a PayPal payment method, payment will be handled by PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal, L-2449 Luxembourg). Available options are displayed during checkout. PayPal may use third-party services. You will be informed if any special conditions apply. § 4 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if your claim arises from the same contractual relationship.
(2) The goods remain our property until full payment.
§ 5 Warranty
(1) Statutory warranty rights apply.
(2) Consumers are requested to check the goods for completeness, visible defects, and transport damage immediately upon delivery and to notify us and the carrier as soon as possible. Failure to do so does not affect your statutory warranty rights.
(3) If a feature of the goods deviates from the objective requirements, this deviation shall only be deemed agreed if you were informed before the contract declaration and the deviation was expressly and separately agreed.
§ 6 Choice of Law
(1) German law applies. For consumers, this only applies if it does not restrict protection under mandatory laws of the consumer’s residence country (principle of favorability).
(2) The provisions of the UN Sales Convention (CISG) do not apply.

3. Contract Language, Storage of Contract Text
3.1. Contract language is German.
3.2. We do not store the full contract text. Before submitting the order via the online shopping cart, you can print or save the contract data using your browser. After receiving your order, we will email you the order data, legally required information for distance contracts, and our terms and conditions.
3.3. For quote requests outside the online shopping cart, you will receive all contract details in text form (e.g., by email), which you can print or save.

6. Prices and Payment Terms
6.1. All prices and shipping costs shown include taxes.
6.2. Shipping costs are not included unless stated otherwise. They are shown during checkout and must be paid by you.
6.3. If delivery is outside the EU, additional costs (e.g., customs, taxes, transfer fees) may apply and must be paid by you.
6.4. Any transfer or exchange fees must be borne by you if payment is made outside the EU but delivery is within an EU country.
6.5. Available payment methods are shown on our website or in the respective offer.
6.6. Unless stated otherwise, payment is due immediately after the contract is concluded.
7. Delivery Terms
7.1. Delivery terms, timeframes, and any restrictions are shown on our website or in the respective offer.
7.2. If you are a consumer, the risk of accidental loss or damage transfers only upon delivery to you, unless you have arranged the shipping independently.
